Terms of use

1. Purpose

DivingDeal.com (the “Site”) is a free information and comparison service for divers, published by Lewin Digital EOOD (see the legal notice). By using the Site, you accept these terms.

2. The role of DivingDeal

DivingDeal is not a travel agency, a tour operator, an insurer or a seller. DivingDeal does not collect any payment from travellers. When you click a link to a partner (accommodation, flight, excursion, liveaboard, dive centre...), the booking is made directly with that business, on the terms of its website. DivingDeal is not a party to that contract and is not responsible for its performance.

3. Published information

The information on the Site (descriptions, prices, availability, entry requirements, health and safety information) is provided for guidance only. It comes from sources that we consider reliable and is updated regularly, but it may be incomplete, may change or may contain errors. Prices and availability are those that partners communicate to us at the time of display: only the price shown on the partner's website at the time of your booking applies.

Entry, visa, health and safety information does not replace the advice of a doctor, that of a diving professional, or the information provided by official authorities: check it with official sources before you travel. Scuba diving is a risky activity: it requires a medical certificate of fitness, a suitable level and appropriate supervision.

4. The assistants Marina and Edith

Marina and Edith are artificial intelligence assistants. They can make mistakes. Their answers are for information only: they constitute neither medical, legal or insurance advice nor a firm offer. Do not give them health data, bank details or identity documents. The processing of your messages is described in the privacy policy.

5. Your account

You create your account with an email address and a one-time code sent to that address. You are responsible for access to your inbox. You can delete your account at any time from “My account”. We may suspend an account that is misused.

6. Intellectual property and database

Database protection. DivingDeal.com constitutes a database protected by Directive 96/9/EC of 11 March 1996 on the legal protection of databases, as transposed into national laws (in the UK, by the Copyright and Rights in Databases Regulations 1997, which created the database right), and by equivalent national laws.

The publisher has made a substantial financial, material and human investment in the obtaining, verification and presentation of the contents of this database: listing and qualification of dive centres, dive sites and accommodation, periodic verification and updating of the published information, and original editorial enrichment.

The following are therefore prohibited without the prior written permission of the publisher:

1. the extraction, by permanent or temporary transfer, of the whole or a qualitatively or quantitatively substantial part of the contents of the database to another medium, by any means and in any form, including by automated scraping, harvesting, systematic manual copying or through a third-party service;
2. the re-utilisation, by making available to the public the whole or a substantial part of the contents of the database, in any form, including after rewording, translation or reorganisation;
3. the repeated and systematic extraction or re-utilisation of insubstantial parts of the contents, where it manifestly exceeds the conditions of normal use of the database.

These prohibitions apply regardless of any copyright protection of the individual elements of the database.

Automated access to the website is reserved for the indexing crawlers of search engines and conversational assistants, within the limits defined by the robots.txt file. Any other automated access is prohibited. Any violation may give rise to the civil and criminal liability of the person responsible.

7. Third-party content and websites

The Site displays content from third parties (photographs, ratings, reviews, videos) and contains links to third-party websites. This content remains the property of its authors. We have no control over the content of third-party websites and are not responsible for it. To request the correction or removal of content, see the legal notice.

8. Liability

The Site is provided as it is, without any guarantee of continuous availability. Nothing in these terms limits any liability that cannot be limited under the law.

9. Governing law

These terms are governed by Bulgarian law. If you are a consumer, the mandatory consumer protection provisions of the law of your country of residence continue to apply to you, and you may bring proceedings before the courts of that country.

10. Changes

We may change these terms; the version in force is the one published on this page.
